Who Should File LLP Form No. 23 / When is it Filed
An entity (company, LLP, or firm) whose name is identical or closely similar to the name of an LLP incorporated after it may file LLP Form No. 23 to seek a direction for the later-incorporated LLP to change its name. The form must be filed within 24 months from the date of incorporation of the LLP against which the complaint is being filed.
Important Checkpoints Before Filing
- Applicant must be registered as a Business User on the MCA portal before filing
- The DSC attached must be registered on the MCA portal against the DIN/DPIN/PAN/Membership number provided
- The DSC must be associated with the LLP for which the webform is filed, except where the DSC belongs to the complainant/applicant
- The signing authority must hold a valid, non-expired, non-revoked DSC, or valid PAN, or valid Membership number, as applicable
- The form must be filed within 24 months from the date of incorporation of the LLP against which the complaint is filed
- On resubmission, the application remains available in the application history, and T+30 days (T being the date marked ‘Resubmission Required’) must not have elapsed

- Fill up the application, providing details of the similarity of names and the LLP against which the complaint is made
- Submit the webform and note the SRN
- Affix the DSC
- Upload the DSC-affixed PDF on MCA portal
